I have spent over 19 years in the practice of law, including commercial matters, both transaction work and court work. In the past few years, I noticed that the number of cases that are litigated has increased unnecessarily. I feel that many cases that ended up before the courts could have been mediated to a settlement. I say that because few cases are about a dispute in interpretation of law. Instead, the majority of cases involve a dispute in perception or understanding of facts, a misunderstanding or misinterpretation of positions of the parties in dispute, or the inability of one party to communicate frankly with another about the real issues behind the dispute. Mediation is a preferred forum to negotiate a settlement of these types of cases. A skilled mediator can assist parties to a dispute to isolate the real issues behind the dispute and the needs of the parties that will bring the dispute to a resolution. It is with this philosophy that I decided to devote a part of my practice to mediation and negotiated settlement.
